This is statutory guidance from the Department. This guidance explains the governing body procedures which came into effect in September 2003. Governing bodies and their clerks must ensure that the procedures they adopt comply with these regulations.

Who is this guidance for?
This guidance is aimed at:
- school governors;
- local authorities;
- clerks to governing bodies;
- school leaders and school staff in all maintained schools in England; and
- governor organisations and other organisations with an interest.
This guidance applies to maintained schools only.
Key points
- the Government is committed to enabling governing bodies to choose ways of working that suit the individual circumstances of their school. The regulations on governing body procedures give governing bodies flexibility to determine their own procedures, whilst maintaining essential safeguards; and
- this guidance provides advice on: the appointment, function and removal of officers; meetings and proceedings; committees; and restrictions on persons taking part in proceedings of the governing body or its committees.
