They are extremely detailed and prescriptive, and allow schools very little scope for agreeing policies that meet their own particular needs.</p> <p>The School Staffing Regulations 2009 require school governing bodies to have procedures for dealing with staff capability issues.&nbsp; When dealing with capability issues for teachers, schools must have regard to statutory guidance.&nbsp; The current guidance takes the form of a model capability procedure which was issued in 2000. The procedure pre-dated the current performance management arrangements, and there are areas of overlap and duplication between the two.</p> <p>The White Paper "The Importance of Teaching" set out plans to shorten and simplify current teacher performance management regulations, and remove the duplication between current performance management and capability procedures.</p> <p>This consultation sought views on revised performance management arrangements that were designed to strip out unnecessary prescription, support school leaders in dealing with underperformance quickly, and give schools much greater freedom to design their own teacher appraisal policies. It offered a new optional model policy that combined appraisal and capability into one coherent procedure that is consistent with the ACAS Code of Practice on Disciplinary and Grievance Procedures and it raised wider questions about other barriers to tackling the underperformance of teachers, and the timing of implementation.</p> <p>250 responses were received from a range of stakeholders including head teachers, teachers, governors, local authorities and professional associations.<a name="_GoBack"></a></p> <p><strong>Next steps</strong></p> <p>New arrangements for teacher and head teacher appraisals in maintained schools in England, and for dealing with underperforming teachers were announced&nbsp;on 13 January 2012.&nbsp;
